DECLARATION OF WATER SHORTAGE EMERGENCY
WHEREAS, pursuant to Section 350 of the Water Code, the Board of Directors (Board) of Fern Valley Water District, (the “District”) may, after a public hearing pursuant to Section 351 of said Code, declare a water shortage emergency condition to prevail within the District whenever it finds and determines that the ordinary demands and requirements of water consumers cannot be satisfied without depleting the water supply of the District to the extent that there would be insufficient water for human consumption, sanitation, and fire protection; and
WHEREAS, on June 20, 2014, the Board held a public hearing at which consumers of the District’s water supply were afforded an opportunity to be heard to protest against the declaration by the Board of a water shortage emergency condition and to present their respective needs to the Board; and
WHEREAS, pursuant to Article 15 of the Rules and Regulations of the district upon declaration by the Board of a water shortage emergency condition within the District, consumers of the District’s water supply are required to thereafter voluntarily limit the amount of water used to that amount necessary for domestic and business purposes; and
WHEREAS, pursuant to Article 15 of the Rules and Regulations of the District, upon a determination by the Board of a water shortage emergency condition, the General Manager of the District is required to monitor the supply and demand of water for the District on a daily basis to determine the level of conservation required for the implementation or termination of the water conservation stages pursuant to Article 15 of the District Rules and Regulations; and
WHEREAS, as a result of less than normal precipitation during the last precipitation season, the District’s water supply has been depleted such that ordinary demands and requirements of consumers of the District’s water supply cannot be satisfied without depleting the water supply of the district to the extent that there would be insufficient water for human consumption, sanitation and fire protection;
NOW, THEREFORE, BE IT RESOLVED, DETERMINED AND ORDERED BY THE BOARD OF DIRECTORS OF FERN VALLEY WATER DISTRICT AS FOLLOWS:
Section 1. Declaration of Emergency. The Board of Directors finds and determines that the ordinary demands and requirements of consumers of the District’s water supply cannot be satisfied without depleting the water supply of the District to the extent that there would be insufficient water for human consumption, sanitation and fire protection, and that a water shortage emergency condition prevails within the are served by the District.
Section 2. Voluntary Compliance. Pursuant to subdivision (a) of Section 15.2 of Article 15 of the Rules and Regulations of the District, the consumers of the District’s water supply shall voluntarily limit the amount of water used to that amount for domestic and business purposes, and shall take all steps reasonably necessary to prevent the waste of water and to assure that all water is beneficially used to the maximum extent possible including, without limitation, preventing leaks, preventing irrigation water run-off, and refraining from washing sidewalks, driveways and other hard-surfaced areas except when necessary to prevent a threat to the public health, safety or welfare.
Section 3. Monitoring. The General Manager of the District shall, pursuant to Section 15.3 of Article 15 of the Rules and Regulations monitor the District’s water supply and the demand thereon on a daily basis to determine the level of conservation required by the implementation of termination of the water conservation stages in accordance with Section 15.2 of Article 15 of the Rules and Regulations. The General Manager is authorized to and shall issue appropriate notices of stage 2 or stage 3 water shortage emergencies as provided in subdivision (b) and (c) of Section 15.2 of Article 15 of the Rules and Regulations when the General Manager determines that it is necessary to issue such notices. Upon such issuance of any such notices, the General Manager shall publish a copy of thereof in the Idyllwild Town Crier in two successive editions, and consumers of the District’s water supply shall implement the mandatory restrictions set forth in subdivisions (b) and (c) of Section 15.2 of Article 15 of the Rules and Regulations, as appropriate. Those restrictions shall be set forth in each notice of a water shortage warning issued and published by the General Manager.
